Acceptance of Terms

By accessing our website, requesting our services, or entering into a contract with ketonugxif, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and ketonugxif B.V. If you do not agree to these terms, you must not use our services or website.

Your acceptance of these terms may occur through various actions including but not limited to: signing a service contract, making a payment, allowing us to commence work on your property, or continuing to use our website after being notified of changes to these terms.

Services Description

ketonugxif provides professional renovation and construction services including but not limited to:

• Kitchen renovations and remodeling
• Bathroom renovations and installations
• Home extensions and additions
• Interior renovations and improvements
• Commercial property renovations
• Structural modifications and repairs
• General construction and building services

Client Obligations

As a client of ketonugxif, you agree to:

• Provide accurate and complete information about your project requirements
• Ensure legal ownership or proper authorization for work on the property
• Obtain necessary permits and approvals (unless specified in our contract)
• Provide safe and reasonable access to the work area
• Make timely payments according to the agreed schedule
• Communicate any changes or concerns promptly
• Comply with all applicable laws and regulations
• Maintain appropriate insurance coverage for your property

Quotations and Contracts

All quotations provided by ketonugxif are estimates based on the information available at the time of assessment. Quotations are valid for 30 days unless otherwise specified. Final pricing may vary based on:

• Unforeseen conditions discovered during work
• Changes in material costs or availability
• Client-requested modifications to the original scope
• Additional work required to meet building codes

A formal written contract will be provided for all projects exceeding €1,000. Smaller projects may proceed based on written quotations and client acceptance.

Payment Terms

Payment terms will be specified in your contract or quotation. Standard terms include:

• Deposit: 25-50% upon contract signing
• Progress payments: As specified in the contract
• Final payment: Within 14 days of project completion
• Late payment fee: 1.5% per month on overdue amounts
• Accepted payment methods: Bank transfer, cash, certified cheque

Intellectual Property

All intellectual property rights in designs, plans, specifications, and other materials created by ketonugxif remain the property of ketonugxif unless otherwise agreed in writing. This includes but is not limited to:

• Architectural and construction drawings
• Design concepts and specifications
• Project documentation and reports
• Proprietary construction methods and techniques

Clients receive a non-exclusive license to use these materials for the specific project only. Reproduction or use for other projects requires written permission from ketonugxif.

Warranties and Guarantees

ketonugxif provides the following warranties on completed work:

• Workmanship: 2 years from completion date
• Structural work: 5 years from completion date
• Materials: As per manufacturer warranties
• Installations: 1 year from completion date

Warranties do not cover normal wear and tear, damage caused by misuse, neglect, or modifications made by others.

Limitation of Liability

To the maximum extent permitted by law, ketonugxif's total liability for any claims arising from our services is limited to the total amount paid for the specific project giving rise to the claim. We shall not be liable for:

• Indirect, consequential, or punitive damages
• Loss of profits, revenue, or business opportunities
• Damage to property not directly worked on
• Delays caused by circumstances beyond our control
• Issues arising from client-supplied materials or specifications

This limitation of liability does not affect your statutory rights as a consumer under Dutch law.

Force Majeure

ketonugxif shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, severe weather, or acts of God
• Government actions, regulations, or permit delays
• Labor strikes, material shortages, or supply chain disruptions
• Pandemic, epidemic, or public health emergencies
• War, terrorism, or civil unrest

Termination

Either party may terminate a contract under the following circumstances:

• By Client: 7 days written notice (subject to payment for work completed and materials ordered)
• By ketonugxif: Immediate termination for non-payment, unsafe conditions, or breach of contract
• Mutual Agreement: As agreed upon by both parties in writing

Upon termination, the client remains liable for all work performed, materials supplied, and reasonable costs incurred up to the termination date.

Insurance and Safety

ketonugxif maintains comprehensive insurance coverage including:

• General liability insurance
• Professional indemnity insurance
• Workers' compensation coverage
• Equipment and materials insurance

We comply with all applicable health and safety regulations and expect clients to cooperate with safety measures during construction.

Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to our privacy practices as outlined in our Privacy Policy.

Dispute Resolution

We encourage clients to contact us directly to resolve any concerns. For formal disputes:

• Initial resolution attempts through direct communication
• Mediation through a recognized Dutch mediation service
• Legal proceedings in the appropriate Dutch courts

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any legal proceedings arising from these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts, specifically the courts of North Brabant.

Where applicable, consumer protection laws of the Netherlands shall take precedence over conflicting provisions in these terms.

Changes to Terms

ketonugxif reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the revision date. For existing contracts, changes will not affect work already in progress unless mutually agreed upon in writing.

Continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original intent.

Entire Agreement

These Terms of Service, together with any written contract or quotation, constitute the entire agreement between you and ketonugxif. No oral representations or additional terms shall modify this agreement unless confirmed in writing.
